The Satanic Temple appeals Missouri State Supreme Court ruling
Judy Doe, a member of The Satanic Temple (TST), sought to have an abortion in the state of Missouri, but she was forced to wait for 72-hours and was required to accept reading material with religious content designed to produce shame that asserts that life begins at conception.
The Satanic Temple filed a lawsuit against the State on her behalf that claims that the adopted policies and procedures by the State violated Doe’s rights under the U.S. Constitution's Free Exercise and Establishment Clauses. After a decision that did not take into account a decision handed down by the U.S. Eight Circuit Court of Appeals, Webster v. Reproductive Health Services, 492 U.S. 490 (1989), which explicitly states that the life of each human being begins at conception is “an impermissible state adoption of a theory when life begins.”
The Satanic Temple, in its appeal, is simply requesting the Court reaffirm its ruling.
Temple spokesperson Lucien Greaves noted, “The only way for The Satanic Temple to lose this case is if the Eighth Circuit reverses itself, which is highly unusual, or goes to impossibly great lengths to avoid ruling on the issues it is being presented with. While I don’t put it past the courts, I am optimistic that the Eighth Circuit will adhere to the law and The Satanic Temple will prevail.” The Satanic Temple’s appeal focuses on the policies and procedures of the State which dictates a personal theory of when life begins for its residents. In place of what should be a personal theory, the State employs its own, two-part theory. The first is that the life of each human being begins at conception and the second is that abortion will terminate the life of a separate, unique, living human.
While the State may make laws that promote health and safety, The Satanic Temple insists that the State may not dictate its beliefs in a manner that “violates [Judy Doe’s] right to choose her own theory of when life begins without government input...and violates the Establishment Clause and Free Exercise Clause” by demanding written acknowledgment by the patient of the State’s doctrine.
Doe and The Satanic Temple believe that decisions regarding one’s body should be based, “on the best scientific understanding of the world, even if the science does not comport with the religious or political beliefs of others.”
